SITE TERMS AND CONDITIONS
This website is owned and operated by Balwyn Watches Pty Ltd (ABN 38 698 409 531), trading as Balwyn Watches (“Balwyn Watches”, “we”, “us” or “our”).
By accessing or using this website, creating an account, submitting an enquiry, consigning or selling an item to us, or purchasing a product from us, you agree to these Terms and Conditions.
1. Definitions
- Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
- Order means an order placed through the Site, by telephone, by email or in store.
- Product means any watch, bag, jewellery item, footwear, fashion item, accessory or other product offered for sale by us.
- Services includes our retail, consignment, appraisal, authentication and outright-purchase services.
- Site means this website and any related online services operated by Balwyn Watches.
2. Products, authenticity and condition
- We sell pre-owned and consigned luxury products. Unless expressly stated otherwise, products are not new and may show signs of previous use, age, storage, servicing or restoration.
- We assess products using our internal processes and, where appropriate, information from independent specialists.
- Product photographs and descriptions are intended to present each item as accurately as reasonably possible. Minor differences may arise because of lighting, screen settings, photography and colour reproduction.
- You should carefully review all photographs, measurements, condition notes, inclusions and descriptions before placing an order.
- For watches, timekeeping accuracy, water resistance, power reserve and service intervals may vary according to age, condition and previous use. Water resistance is not guaranteed unless expressly confirmed by us in writing following a current pressure test.
- We are an independent reseller and are not affiliated with, authorised by or endorsed by the manufacturers or brand owners whose products we sell.
3. Orders and availability
- An order submitted by you is an offer to purchase. An order is accepted only when we issue an order confirmation or dispatch the product, whichever occurs first.
- Products may be unique, consigned or available in a single quantity. Adding a product to your cart does not reserve it.
- We may decline or cancel an order where the product is unavailable, payment is declined, identity verification is not completed, fraud is suspected, or delivery cannot be safely or lawfully completed.
4. Pricing and payment
- Unless otherwise stated, prices are in Australian dollars and include GST where applicable.
- Payment must be made using a payment method accepted by us.
- Where an order is cancelled at the customer’s request, Balwyn Watches may deduct reasonable, non-refundable payment-processing costs actually incurred, to the extent permitted by law. No deduction applies where a refund is required under the Australian Consumer Law.
5. Identity and payment verification
- We may require identity, address, payment or source-of-funds verification before accepting, dispatching or releasing a high-value order.
- Verification may include government-issued photo identification, proof of address, confirmation of payment-card details, or another reasonable verification step.
- We handle verification information in accordance with our Privacy Policy and applicable law.
6. Returns and refunds
- You may request a voluntary return within 7 calendar days after confirmed delivery.
- To request a return, email info@balwynwatches.com.au within the 7-day period and wait for return instructions before sending the product.
- The product must be returned in the same condition in which it was supplied, unworn, unused and unaltered, with all security tags, packaging, certificates, accessories and documents intact.
- A voluntary return may be refused where the product has been worn, damaged, resized, engraved, serviced, repaired, altered, exposed to water, or returned without its original security tag or supplied inclusions.
- For voluntary returns, you are responsible for return shipping, insurance and risk until the product is received by us.
- Nothing in this clause excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
7. Consignment
- Products submitted for consignment are subject to our separate consignment agreement, appraisal, authentication and acceptance processes.
- You warrant that you are the legal owner of the consigned product, have full authority to consign it, and that it is authentic and lawfully acquired.
8. Selling products to us
- Products offered for outright sale are subject to inspection, authentication, valuation and our written acceptance.
- Any initial estimate is indicative only and is not a binding offer.
- You warrant that you are the legal owner and have full authority to sell the product.
9. Shipping and delivery
- We will arrange delivery to the address provided by you at checkout, using a carrier and service that we consider appropriate for the product’s nature and value.
- We do not deliver to PO boxes, parcel lockers, post-office collection points or similar unattended collection addresses. You must provide a valid residential or business street address where the delivery can be accepted and, where required, signed for.
- You are responsible for ensuring that the recipient’s name, delivery address, telephone number and other delivery information are complete and accurate. We are not responsible for delay, redirection, loss or additional charges caused by incorrect or incomplete information supplied by you, except to the extent required by law.
- High-value orders may require signature on delivery, identity confirmation or delivery to the verified billing address. They may not be eligible for safe drop, authority to leave or unattended delivery.
- A person accepting delivery at the nominated address is treated as authorised to receive the order unless you have notified us otherwise and we have agreed to an alternative arrangement in writing.
- Delivery timeframes are estimates only. Delays may occur because of carrier disruption, security checks, payment verification, public holidays, weather, customs, remote-area delivery or other events beyond our reasonable control.
- We may split an order into more than one delivery where reasonably necessary. Where this occurs, we will not charge additional delivery fees unless agreed with you.
- You must inspect the parcel promptly after delivery. Visible parcel damage, tampering, missing contents or delivery discrepancies should be reported to us as soon as reasonably possible, together with photographs and supporting information.
- You must not dispose of packaging or delivery materials while a delivery claim is being investigated.
- Where a delivery attempt fails because no authorised person is available, you may be responsible for reasonable redelivery, storage or return-to-sender costs, except where the failure was caused by us or the carrier.
- Risk in the product passes to you when the product is delivered to the nominated address or collected by you or your authorised representative, except to the extent otherwise required by law.
- Title to the product passes only after we have received full cleared payment.
- We may suspend, redirect or recall a shipment where we reasonably suspect fraud, payment reversal, delivery risk, unlawful activity or an error in the order.
- For international orders, you are responsible for checking local import restrictions and for paying customs duties, import taxes, brokerage, clearance charges and other destination-country charges, unless we expressly agree otherwise in writing.
- We are not responsible for a refusal, seizure, delay or return caused by destination-country customs or import requirements, except to the extent caused by our breach of law or these Terms and Conditions.
10. Intellectual property
- The Site and its content are owned by or licensed to Balwyn Watches and are protected by intellectual-property laws.
- You must not reproduce, modify, distribute, publish, scrape or commercially exploit any part of the Site without our prior written consent.
11. Privacy
- Our Privacy Policy forms part of these Terms and Conditions.
- We may collect and use personal information to process orders, provide services, verify identity, prevent fraud and meet legal obligations.
12. Australian Consumer Law
- Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.
- Nothing in these Terms and Conditions excludes, restricts or modifies a statutory guarantee, warranty, right or remedy that cannot lawfully be excluded.
13. Liability
- Nothing in this clause limits liability where doing so would be unlawful.
- To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from use of the Site or a product.
14. Changes to these terms
- We may update these Terms and Conditions from time to time by publishing the revised version on the Site.
- Changes apply from the date of publication and do not retrospectively alter an order already accepted unless required by law or agreed with you.
15. Governing law
These Terms and Conditions are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
